These terms & conditions govern your use of the GlassesSpecsDirect.co.uk website (the “Glasses Specs Direct site”), the terms of any purchases that you make via the Glasses Specs Direct site, and your relationship with (“Glasses Specs Direct”, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. By using the site and/or registering on the site, you agree to these terms and conditions and to our privacy policy.

Part A: Your Use of the Glasses Specs Direct Site

1     Basis of Use of the Glasses Specs Direct Site

1.1       The Glasses Specs Direct site is provided to you free of charge for your personal use subject to these terms & conditions and our privacy policy. By using the Glasses Specs Direct site you agree to be bound by these terms & conditions and our privacy policy.

1.2       These terms & conditions govern your use of the Glasses Specs Direct site in general, the products that you purchase on the Glasses Specs Direct site and all services provided in connection with them.

1.3       These terms & conditions do not affect your statutory rights.

2     Registration

3     Password & Security

3.2       If Glasses Specs Direct has reason to believe that there is likely to be a breach of security or misuse of the Glasses Specs Direct site, we may require you to change your password or we may suspend your account in accordance with paragraph 20 below.

4     Intellectual Property

4.1       The content of the Glasses Specs Direct site is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the Glasses Specs Direct site on a computer screen, or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Glasses Specs Direct site without express written permission from Glasses Specs Direct.

4.2       No license is granted to you in these terms & conditions to use any trademark of Glasses Specs Direct or its affiliated companies.

5     Limitations

5.1       You may not use the Glasses Specs Direct site for any of the purposes set out below

(a) disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;

(b) transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

(c) gaining unauthorized access to other computer systems;

(d) interfering with any other person’s use or enjoyment of the Glasses Specs Direct site;

(e) interfering or disrupting networks or web sites connected to the Glasses Specs Direct site;

(f) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;

(g) transmitting material containing any form of advertising or promotion for goods and services, junk mail, chain letters or “spam”;

(h) impersonating another person;

(j) advertising

5.2       Glasses Specs Direct reserves the right to refuse to post material on the Glasses Specs Direct site or to remove material already posted on the Glasses Specs Direct site. You must not try to re-post material which Glasses Specs Direct has refused to post on the Glasses Specs Direct site or has previously removed from the Glasses Specs Direct site.

5.3       You will be responsible for all (direct or indirect) losses, costs and expenses incurred by us, all damages awarded against us by a court and all professional or administrative fees, interest charges or penalties paid by us as a result of any settlement agreed by us arising out or in connection with:

(a) any claim by any third party that the use of the Glasses Specs Direct site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or is in breach of any applicable law, regulation or code of practice; and

(b) any claim by any third party that the use of the Glasses Specs Direct site by you infringes that third party’s copyright or other intellectual property rights of whatever nature.

5.4       By submitting material you are granting Glasses Specs Direct a perpetual, royalty-free, non-exclusive license to reproduce, modify, translate, make available, distribute and sublicense the material in whole or in part and in any form.

6     Third Party Websites

As a convenience to Glasses Specs Direct customers, the Glasses Specs Direct site may include links to other websites or material. Glasses Specs Direct is not responsible for any of these websites or material which is beyond its control.

7     Advertising & Sponsorship

Part of the Glasses Specs Direct site may contain advertising and sponsorship. Third party advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Glasses Specs Direct site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material provided by third parties.

8     Availability of the Glasses Specs Direct Site

8.1       Although Glasses Specs Direct aims to offer you the best service possible, Glasses Specs Direct cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the customer services team (see paragraph 23 below for contact details) or by email at info@glassesspecsdirect.co.uk and we will attempt to correct the fault as soon as we reasonably can.

8.2       Your access to the Glasses Specs Direct site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

Part B: Purchasing Products from the Glasses Specs Direct Site

9     Specific Product Terms

9.1       The terms in this Part B apply to any purchases that you make on the Glasses Specs Direct site.

9.2       Some purchases made on the Glasses Specs Direct site will also be governed by specific product terms – please go to Part D of these terms and conditions to see if any of the products you are purchasing have additional specific product terms.

9.3      All our glasses include a basic bronze lens of 1.5 index, excluding rimless and semi-rimless frames. Dependent on your prescription a higher index may be required. We will make a recommendation after entering your prescription. However, please be aware certain prescriptions cannot be manufactured in a bronze 1.5 index lens, such as rimless and semi-rimless frames.

10   Descriptions and Prices of Products

10.1     We have taken care to describe and show products as accurately as possible. Despite this, products may vary from their descriptions. If there is anything which you do not understand, or if you wish to obtain further information, please contact customer services (see paragraph 23 below for contact details).

10.2     If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we dispatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy in paragraph 16 below.

10.3     All prices are expressed inclusive of any VAT payable unless otherwise stated.

11   Availability

11.1     All products advertised are subject to availability or while stocks last.

11.2     We try to ensure that we always stock the full product range and will let you know if the product is out of stock. If for any reason beyond our reasonable control we are unable to supply a particular product, we will not be liable to you except to ensure that you are refunded for the product, in full.

11.3     In the interests of all our customers, we may place restrictions on bulk buying of some products. If you try to bulk buy products that have bulk buying restrictions, we will automatically reduce the number of products you’re trying to buy by adding the maximum amount allowed to your basket rather than the amount requested.

12   Acceptance of Orders

12.1     Your order is an offer to buy from us. We will send you an order acknowledgement email detailing the products you have ordered and an estimated date for delivery. Please note that this email is not an order confirmation or an acceptance of your order by Glasses Specs Direct.

12.2     Nothing that we do or say will amount to any acceptance of your offer until we send you an email notifying you that we have dispatched a product to you. At this point a contract will be made between us for you to buy and us to sell the products that you have ordered from us. Where products are dispatched our acceptance of the order in respect of each product takes place when we notify you by email of such dispatch.

12.3     30 minutes after the time the contract is made, you cannot amend your order (but please see your right to cancel an order in paragraph 14 below).

12.4     At any point up until the contract is made, we may decline to supply a product to you. If we decline to supply a product to you and you have already paid for it, we will give you a full refund of the amount already paid for that product in accordance with our refund policy in paragraph 16 below.

13   Delivery

13.1     Delivery will be made to the address specified when you complete the order.

13.2     For the UK, a complete pair of glasses are delivered by Royal Mail and delivery costs £3.95, though costs may vary for non-mainland territories. Individual international orders are all delivered via Royal Mail and postage charges are subject to zone. (excluding Next Day Glasses). If any loyalty points, coupons or other promotions are used on your order and the order value drops below the free delivery threshold, you will be required to pay the standard shipping fee.

13.3     Whilst we make considerable effort to dispatch all your products within 48-72 hours (excluding weekends) subject to prescription complexity, we shall not be liable if we fail to do so in part or in full due to circumstances beyond our control.

13.4    Shipping Insurance costs £2.99 for UK orders. In cases when a package does get lost by the courier, we will provide a replacement item free of charge. (excluding Next Day Glasses).

13.5    Next Day Glasses are subject to Qualifying prescriptions only, single vision silver lens option without Add-ons. UK Mainland only, next day delivery excludes weekends and public holidays. Next Day Glasses service is charged at £29.95 per frame.

14   Cancelling Your Order If You Change Your Mind

We hope that you will be happy with your purchase but if you change your mind you may cancel your order up to 30 minutes from the point of acceptance of order.

15   Faulty Products

If your products arrive damaged or they are faulty, you may return them and obtain a refund or replacement product by going through the online returns process.

16   Refunds

16.1     If you are entitled to a refund, we will refund you in the method that payment was made.

16.2     Refunds can take 7-10 working days to appear in your account. We’ll make any refund payment due to you (excluding initial delivery costs) within 20 working days from the day the order is dispatched.

16.2     Refunds for products purchased under a promotional offer will be based on the terms of the promotional price.

16.3   Should you wish to return any frame only (No lenses) orders, the total refund amount will exclude fixed production costs incurred by us which is £1.95 per item + shipping cost which is £7.95 .

17   Payments & Cards

17.1     Payment for your products will be taken at the time your place your order. If there is a problem taking payment for all or part of your order we will contact you by email.

17.2     Your credit/debit card details will be encrypted by the Braintree site to minimize the possibility of unauthorized access or disclosure.

17.3     When ordering from the Glasses Specs Direct site we accept orders only from web browsers that permit communication through Secure Socket Layer (SSL) technology, for example an 11 version or higher of Internet Explorer, version 5 or higher of Firefox, Chrome version 60 or higher and Safari version 8 of higher. This means that you cannot inadvertently place an order through an unsecured connection. Please note these web browsers and versions may change from time to time.

17.4    We are unable to accept NHS or opticians’ vouchers.

18   Free Gifts, Promotional Products, & Ecoupons

18.1     Free gifts and promotional products that are given away in conjunction with a purchase may be despatched to you separately and delivery times may vary.

18.2     If you change your mind and return your product you must also return any free gift or promotional product associated with the promotion and received by you as a result of that order. We may charge you a reasonable amount for the free gift if you do not return it.

18.3     Where indicated on the Glasses Specs Direct site, we may accept eCoupons, subject to these terms & conditions and any other specific conditions notified to you on the issue of the eCoupons.

Part C: Your Use of the Glasses Specs Direct Site & Purchasing Products from the Glasses Specs Direct Site

19   Amendments

We may update these terms & conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Glasses Specs Direct site. The changes will apply to the use of the Glasses Specs Direct site after we have given notice. If you do not wish to accept the new terms & conditions you should not continue to use the Glasses Specs Direct site (including purchasing any products on the Glasses Specs Direct site). If you continue to use the Glasses Specs Direct site after the date on which the change comes into effect, your use of the Glasses Specs Direct site indicates your agreement to be bound by the new terms & conditions.

20   Right to Suspend or Close Your Account

20.1     We may suspend or close your account immediately at our reasonable discretion or if you breach any of your obligations under these terms & conditions. You will not be able to order products on the Glasses Specs Direct site if your account is suspended or closed.

20.2     The suspension or closure of your account and your right to use the Glasses Specs Direct site shall not affect either party’s existing rights or liabilities.

21   Our Responsibility to You

21.1     The Glasses Specs Direct site is provided by Glasses Specs Direct without any warranties or guarantees. You will bear the risks associated with the use of the internet.

21.2     The Glasses Specs Direct site provides content from other internet sites or resources and while Glasses Specs Direct tries to ensure that material included on the Glasses Specs Direct site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Glasses Specs Direct will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Glasses Specs Direct site. If Glasses Specs Direct is informed of any inaccuracies in the material on the Glasses Specs Direct site we will attempt to correct the inaccuracies as soon as we reasonably can.

21.3     In particular, we disclaim all liabilities in connection with the following:

(a) incompatibility of the Glasses Specs Direct site with any of your equipment, software or telecommunications links; and

(b) technical problems including errors or interruptions of the Glasses Specs Direct site.

21.4     If we are in breach of these terms & conditions, we will only be responsible for any losses that you suffer as a direct result to the extent that they are a foreseeable consequence to both of us at the time you order the relevant product or the time you otherwise use the Glasses Specs Direct site.

21.5     Because we sell products for personal use only, our responsibility to you is limited and shall not include any business losses such as lost data, lost profits, lost sales or business interruption.

21.6     This paragraph 21 does not limit or affect our responsibility to you if something we do negligently causes death or personal injury.

22   Miscellaneous

22.1     You may not transfer any of your rights under these terms & conditions to any other person. We may transfer our rights under these terms & conditions to another business where we reasonably believe your rights will not be affected.

22.2     If you breach these terms & conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms & conditions.

22.3     Neither party shall not be responsible for any breach of these terms & conditions caused by circumstances beyond that party’s control.

22.4     Except as expressly set out in these terms & conditions, all use of your personal information will be made in accordance with our privacy policy.

22.5     These terms & conditions are subject to English law, and you submit to the exclusive jurisdiction of the English courts. We will try to solve any disagreements quickly and efficiently.

22.6    Dog ate your specs? Survey | By completing the survey, you give us permission to use your ‘glasses mishaps’ stories anonymously as part of our campaign. We will not share your name across our marketing channels or pass any contact details on to any third parties. The giveaway winner’s name will be drawn at random on Friday 21st February 2020. The winner will be given a voucher code to the value of £50 and this must be redeemed by 30 April 2023.

Part D: Specific Product Terms

24   Prescription Glasses

24.1     By making an order for prescription glasses you are confirming that:

(a) you or the individual you are purchasing on behalf of are aged 16 years or over;

(b) you or the individual you are purchasing on behalf of are not registered blind or partially sighted;

(c) you or the individual you are purchasing on behalf of have a valid current prescription for your glasses or the glasses of the individual you are purchasing on behalf of which is not over 2 years old;

(d) the information you enter into the Glasses Specs Direct site is true and matches your glasses prescription or the glasses prescription of the the individual you are purchasing on behalf of as provided by your optician;

(e) you have written proof of your PD* measurement from your optician or the optician of the individual you are purchasing on behalf of and acknowledge that the measurement entered is correct and valid

(f) you know of no reason why the glasses which you are ordering are not suitable for your requirements or the requirements of the individual you are purchasing on behalf of.

24.2     An additional charge of £40 per item will apply to any prescription that has a prism, or is outside our online prescription parameters.

Part E: Special Offers

Any offer, promotion, discount code, prize draw, or gift (”the Offer”) offered by Glasses Specs Direct have the following Terms and Conditions:

The Offer runs for a finite period, as defined in each offer’s individual terms and conditions below. If no end date is defined then the offer is valid until further notice.

The Offer cannot be used in conjunction with any other offer, and can only be redeemed once by the same customer within the active period.

The Offer is subject to availability. Where applicable, the Offer will only continue while stocks last.

We reserve the right to end the Offer or to amend these terms and conditions at any time without prior notice, as well as the right to exclude anybody from participating in the Offer on reasonable grounds.
